Failure to Diagnose Kawasaki Disease Suit Successfully Defended

D.C. Offutt, Jr. and Jody M. Offutt successfully defended a Beckley, West Virginia physician accused of failing to timely diagnosis Kawasaki Disease.  The patient was a five week old infant who presented to his pediatrician with classic signs and symptoms of bronchiolitis.  He was admitted and treated at a local  hospital and was released two days later.  Approximately two weeks after his discharge from the hospital, the infant presented to the hospital's emergency room with bluish extremities and a fever.  The defendant physician evaluated the patient and transferred him to WVU Medical Center within hours for further treatment.  At WVU, the infant was diagnosed as suffering from Kawasaki Disease, a rare vascular disease that was first recognized and diagnosed in Japan in the 1970's.  Treatment options are limited and the condition can lead to heart damage or other vascular problems.  In some cases, the condition can be fatal.  As a result of the Kawasaki Disease, the infant suffered vascular problems in his lowe extremities and underwent a below the knee amputation and partial foot amputation.  Trial began on October 20, 2009.  After four days of trial, the plaintiff voluntarily dismissed the defendant physician from the suit.  Civil Action No.: 07-C-268, Circuit Court of Raleigh County, West Virginia.
