Firm Successfully Defends Failure to Diagnose Breast Cancer Case.

 D.C. Offutt, Jr. and Jody M. Offutt successfully defended a Princeton, West Virginia general surgeon in a failure to timely diagnosis and treat breast cancer medical malpractice suit.  The patient alleged that the defendant physician was negligent in failing to diagnose and treat infiltrating ductal carcinoma, which over time developed into inflammatory breast cancer.  At trial, the defendant introduced evidence showing that the patient suffered solely from primary inflammatory breast cancer, which is an extremely aggressive form of the disease, and that the physician's early diagnosis and immediate treatment saved the patient's life.   Trial began on March  10, 2009.  After 6 days of trial, the jury returned a unanimous verdict in favor of the defendant physician.  Civil Action No.: 06-C-866, Circuit Court of Mercer County, West Virginia.
