D.C. Offutt, Jr., successfully defended a Wheeling pediatrician in a medical malpractice action in Ohio County, West Virginia. The plaintiffs alleged that the defendant pediatrician, who was the pediatrician on call at the hospital, failed to properly recognize and respond to a newborn infant's respiratory distress following birth, resulting in severe brain damage and permanent injury. The plaintiffs' counsel requested the jury to award over $16M at trial for the future life care costs for the child. Following a seven day trial, the jury returned a verdict for the defendant on March 6, 2007, finding that the physician did not breach the standard of care in his care and treatment of the infant.
