D.C. Offutt, Jr. successfully defended a Charleston gastroenterologist in a wrongful death suit filed by the decedent's estate in the Circuit Court of Kanawha County, West Virginia.

D.C. Offutt, Jr. successfully defended a Charleston gastroenterologist in a wrongful death suit filed by the decedent's estate in the Circuit Court of Kanawha County, West Virginia. The decedent presented to an emergency room complaining of an obstructive food bolus, which necessitated an endoscopy to remove the food bolus. During the procedure, the patient developed a laryngospasm which resulted in a total airway obstruction. The plaintiff alleged that the physician negligently performed the endoscopy which resulted in the patient developing a hypoxic brain injury leading to her death. The jury found that the gastroenterologist did not breach the standard of care and returned a defense verdict on July 13, 2007 at the conclusion of a 4 day trial.
