D. C. Offutt, Jr., and Cheryl A. Eifert successfully defended a Huntington cardiothoracic surgeon in a wrongful death suit filed by the patient's estate in the Circuit Court of Cabell County, West Virginia. The patient-decedent underwent repeat open heart surgery to replace a defective mitral valve. As her chest was being opened, the patient experienced a massive hemorrhage, causing permanent brain damage. Before she passed away over four years following the surgery, she had incurred over $2.5M in medical care expenses. Trial began on May 19, 2008 and the jury returned a unanimous defense verdict in under 30 minutes following a five day trial.
